How can I bring foreign workers to Canada?

LMIA (Labor Market Impact Assessment) 

  • Many employers require positive LMIA decision when hiring foreign workers. The LMIA will assess the impact of your hire on the Canadian Labor market.  To obtain a Positive LMIA Certification you must demonstrate that you need a foreign worker and you must prove that you are unable to fill the current job vacancies of any Canadian citizen or permanent resident. 

  • You must obtain the Labor Market Impact Assessment decision from Employment and Social Development of Canada.

  • Applications are evaluated in 4 different categories:

    • High Salary Foreign Workers

    • Low Salary Foreign Workers

    • Agricultural Workers

    • Seasonal Employees

  • ​$1,000 transaction fee is charged for each position review. 

  • There is a special approach for companies that have not employed foreign workers in the last 6 years. It is taken into account that the company is not subject to any penalties or lawsuits. 

  • Your job and job offer must be legitimate.

  • Your supporting documents must ensure that your company does not have any non-compliance, that you meet your responsibilities in your job offer, that you offer a service or product in Canada, that the job you offer is related to your job. 

  • Your CRA documents are among the documents you need to add to your application. 

  • Your compliance with Federal and State Laws will also be considered. 

  • Prior to applying for an LMIA, you must post a job at the Government of Canada's Job Bank. In addition to this, you must have carried out at least 2 more employment activities. The job posting period must be within the period of 4 weeks of continuous posting within a 3-month period. 

  • Health insurance should also be provided by the employer during the period when the worker is in foreign status. 

  • The languages ​​required are English or French. However, if another language is required, an explanation is required. Language may not be required for some jobs. In this case, the employee should be told how to continue the job. 

  • The application can be made 6 months before the anticipated starting time.  A copy of the positive LMIA decision is given to the worker.  The worker can apply for a permanent residence permit with this document.
